NCREC Education Extensions

As many of you are already aware, the North Carolina Real Estate Commission (“NCREC”) recently passed emergency rules allowing for synchronous distance education (i.e. online in real time), as well as extensions of time to complete continuing education (“CE”) and postlicensing education (“POST”). Several people have asked about their respective deadline for both CE and POST, so I’ll address each extension of time under the emergency rule in turn.

Continuing Education

• Any licensee who has not completed their 2019-2020 CE by June 10 will receive an automatic extension of time until September 30, 2020
• That said, there will still be a blackout period from June 11 through June 30 where no CE may be offered, and the 2019-2020 Update courses (BICUP and GENUP) “die” on June 10
• Therefore, if you do not complete this year’s Update course, you will need to take an elective CE course by September 30 in order to make up that CE credit, and if you do not complete any of this license year’s CE, you’ll need to take two electives by September 30
• Please remember that you do NOT need to complete CE in order to renew your license (i.e. pay the $45 between May 15 and June 30), so please be sure to renew, even if you haven’t completed your 2019-2020 CE by June 10

Postlicensing Education

• Any Provisional Broker (“PB”) whose deadline to complete POST falls between March 14 and June 30 will automatically be granted a 90-day extension if they have not completed their necessary POST course(s)
• No written extension is required if the PB’s deadline falls within the above timeframe
• Extensions will not be automatically granted for deadlines after June 30
• Please keep in mind that the “shelf life” of POST courses is changing on July 1 (from 3 years to 2 years), so courses taken in the past will time out more quickly
• Given that, it is prudent for every PB to complete their POST courses as soon as is practicable

NCREC Emergency Rule on Education

21 NCAC 58G .0104 is adopted under emergency procedures as follows: 1

(a) Schools and course sponsors shall cancel or suspend all in-person courses until April 30, 2020. 5
(b) Until June 10, 2020, schools and course sponsors may offer synchronous distance-learning for continuing 6 education courses. Until June 30, 2020, schools and course sponsors may offer synchronous distance-learning for 7 prelicensing and postlicensing courses. “Synchronous distance-learning” means the instructor and students are 8 separated only by distance and not time, allowing for real-time monitoring of student participation. 9
(c) Schools shall allow students to make-up prelicensing and postlicensing course hours by attending another course 10 of the same type offered by the same school. The make-up hours attended by the student shall be for the same content 11 that the student missed. 12
(d) An applicant who is unable to take the licensing examination within 180 days pursuant to 21 NCAC 58A .0401 13 due to illness or the testing service locations being closed shall make a written request using the Commission’s website. 14 The Commission shall grant each applicant an extension to take the licensing examination. 15
(e) A broker requiring an extension of time to complete the 12-hour Broker-in-Charge Course pursuant to 21 NCAC 16 58A .0110(e) and .1712(b)(5) shall make a written request using the Commission’s website prior to the licensee’s 17 original 120 day deadline. The Commission shall grant each broker an extension to complete the 12-hour Broker-in-18 Charge Course. 19
(f) The Commission shall grant all brokers an extension of time to complete postlicensing or continuing education 20 courses. 21
(g) The Commission shall waive the prelicensing and postlicensing course examination requirements of 21 NCAC 22 58H .0210(a)(2), .0210(b)(2) and .0210(c). 23

Yesterday afternoon, March 18th, the NC Real Estate Commission voted to approve Emergency rules that allow for online education through at least the end of the license year. In addition to online classes, the emergency rules allow for extensions of time to complete this license year’s CE requirements and to complete postlicensing courses. The State still needs to approve the emergency rules, which is expected to happen and will take roughly 8 days.
The Sky Land School of Real Estate, the educational division of LOTSAR, will be offering online CE and postlicensing courses ASAP. First, we are holding a full day of CE on 3/30 to replace the classes originally scheduled for 3/23. Those originally signed-up for the 3/23 classes will need to re-register if they wish to take the 3/30 classes.
Next, the Post 303 course originally scheduled for dates in March will now be held from 4/1 through 4/10. Otherwise, we are keeping our education schedule as currently reflected on our website, albeit, of course, in an online setting.
